Description:
Early Neutral Evaluation (ENE) is designed to help parties resolve family court cases before significant financial and emotional resources are expended on litigation. Two primary ENE processes—Social Early Neutral Evaluation (SENE) and Financial Early Neutral Evaluation (FENE)—help families reach agreements on parenting and custody (SENE) and financial and property issues (FENE).
ENE typically follows an Initial Case Management Conference (ICMC), which occurs after the first pleading is filed. At the ICMC, the judicial officer explains available ADR (Alternative Dispute Resolution) options, including SENE and FENE, and outlines the benefits of these programs. Participation is voluntary, but these processes often prevent entrenched conflict, lengthy timelines, and high legal costs.
SENE is a confidential, settlement-focused ADR process conducted by a two-person male/female evaluator team. The evaluators meet with parties (and their attorneys, if represented) to provide feedback on likely court outcomes and to facilitate resolution on custody and parenting time issues.
FENE addresses financial matters such as asset division, spousal maintenance, child support, and other monetary disputes. The evaluator offers a neutral analysis of the financial issues and guides parties toward mutually acceptable agreements.
